Windham advances one of largest conservation projects in town history

Score one for conservation and the protection of natural landscape and wildlife habitats in the Town of Windham.

On Tuesday evening, members of the Windham Town Council authorized the town manager to apply for U.S. Forest Service Community Forest Program, Land For Maine’s Future Program, and Land and Water Conservation Fund grants, and any other grants for the purchase and development of the proposed Little Duck Pond Community Forest, and to take any other necessary action related to creating a Little Duck Pond Community Forest steering committee.

In October, the council announced a partnership with the Presumpscot Regional Land Trust to preserve the unique and undeveloped character of the property surrounding Little Duck Pond in east Windham off Falmouth Road and to protect the high-quality habitat of the forest and associated ecosystems, while also providing a variety of opportunities for well-managed multi-use outdoor recreation, trail access and scenic enjoyment for the general public for generations to come.

The property is within one of the largest undeveloped forested blocks of land in the region. It includes Atherton Hill which at nearly 600 feet is the largest hill in Windham and includes 1,545 feet of frontage along Little Duck Pond and 1,500 feet of stream frontage that provides wild brook trout habitat.

In addition, nearly 25 percent of the land has been identified by state scientists as a significant deer wintering area, one of just a few large deer wintering areas remaining in the region.

When Windham’s Open Space Plan was adopted in February, the council specifically identified making permanent protection of current areas used as open space and parks a priority and establishing management plans for town-owned properties and developing partnerships on open space protection.

During the Tuesday meeting, Rachelle Curran Apse, the Presumpscot Regional Land Trust executive director, praised the council for reaffirming its commitment to the project.

“We’re so glad to be collaborating with the Town of Windham on this exceptional Little Duck Pond Community Forest Project,” Apse said. “The partnership allows the town to be the land owner and the land trust to hold a conservation easement on the land ensuring the project will forever be conserved for wildlife habitat and for multi-use outdoor recreation. 

The council also authorized Tibbetts to seek agreements for the eventual purchase of several parcels of lands surrounding Little Duck Pond area which will be added to the conservation project. This was a necessary step before grant application paperwork is submitted in January.

Council member Brett Jones was appointed by the council to serve on the newly created Little Duck Pond Steering Committee, which will make recommendations and give input to the council about the project.

Jones said he hopes to see the committee include as many differing viewpoints and interests regarding the potential recreational use of the property as possible. Some uses could include miles of new trails for walkers, bikers, snowmobilers, and ATVs, while continuing to provide hunting access, which Jones said he supports.

The Little Duck Pond property abuts other properties which together provide a block of nearly 750 acres of contiguously conserved land in the towns of Windham and Falmouth and provides an unfragmented forest habitat corridor of exceptional size.

Once completed, the protected area will become part of a nearly 2,000-acre contiguously conserved land area connecting with Windham’s Lowell Preserve, the North Falmouth Community Forest, and the Blackstrap Hill Preserve. Through its 40 acres of protected wetlands the project also will provide high-quality habitat for species such as spring peepers, spotted salamanders, and leopard frogs.

In moving the project forward, councilors said that the goal of this new Little Duck Pond project is to mirror Windham’s highly popular Lowell Preserve in ensuring the land that is conserved will never be subdivided or developed and multi-use trails will always be available for the community.

About $3 million in funding needs to be raised within the next year to pay for land acquisition costs, trail building, recreational amenities, and long-term stewardship of the land for wildlife and people, said Windham Town Councilor David Nadeau estimated in October.

“This significant project is possible because the town is committed to investing in this project locally while also raising state, federal, and private funds in collaboration with the Land Trust,” Nadeau said. “Like Lowell Preserve, the town looks forward to collaborating with the Land Trust to conserve the land and provide shared management of trails so they are welcoming for all.” <

Slate of candidates set for Windham town election in November

The list of candidates for public office in Windham has been finalized and includes a few incumbents seeking re-election and some new faces hoping to obtain enough votes to be elected to available positions.

After filing paperwork with the town clerk’s office by the established deadline of Sept. 3, the candidates will now embark upon their campaigns after being officially placed on the ballot by Windham Town Clerk Linda S. Morrell.

The election will be on Tuesday, Nov. 2 in the Auxiliary Gym at Windham High School. Polls will open at 7 a.m. and close at 8 p.m. on Election Day.

Morrell said that as of Tuesday, there are 14,447 registered voters in Windham, but she’s not expecting a large turnout for this election.

“I would expect between the absentees and in-person voting at the polls about 2,500 to 3,800 votes which has been the turnout in the past,” Morrell said. “If anything brings them out, it will be Question 1 on the state ballot. I don’t think the candidate ballot will generate too much interest.”

Question 1 on the state ballot asks voters if they want to ban the construction of high-impact electric transmission lines in the Upper Kennebec Region and to require the Maine Legislature to approve all other such projects anywhere in Maine, both retroactively to 2020, and to require the legislature, retroactively to 2014, to approve by a two-thirds vote such projects using public land.

Local candidates on the November ballot include incumbent David J. Nadeau, who is running unopposed for the Windham Town Council’s At-Large seat for a three-year term.    

Nadeau currently serves as the chair of the Windham Town Council and has been a town councilor for 10 years and previously spent 10 years as a member of Windham’s Planning Board. He was a recipient of the Maine Planners Association’s Citizen Award in 2020 for his long-term vision for the community, volunteerism, mentoring other volunteers and elected officials as well as going above and beyond in understanding planning initiatives and goals of Windham’s future success.

Incumbent Edward M. Ohmott is seeking a one-year term on the council for an At-Large position.

Ohmott was appointed to fill the At-Large vacancy on the council during a meeting on May 25 following the resignation of Councilor David Douglass.

He previously served on Windham’s Smith Cemetery Committee and Long-Range Planning Committee. Since his appointment to the council, Ohmott has been a member of the town’s Marijuana License Fee Committee.

He’s the former president of Champion Cordage, an industrial supplies and equipment firm in California.

No declared candidate filed paperwork for the Windham Town Council’s West District for a three-year term. The position is currently held by Timothy Nangle, but he did not file papers for re-election. Nangle has been serving as the council’s parliamentarian. 

Morrell, Windham’s longtime Town Clerk, filed paperwork seeking re-election to the position. Morrell originally spent eight years as a ballot clerk during Windham elections, then worked as a deputy clerk for the Town of Windham for seven years. She has served the last 27 years as Windham’s Town Clerk overseeing elections and the town clerk’s office at the Windham Town Hall. 

Incumbents Jennie Butler and Christina Small are seeking re-election for three-year terms as RSU 14 board directors. Two seats on the board are up for grabs with six declared candidates.

Butler taught math at the high school level for 31 years and part-time at the University of Southern Maine. She has formerly been a candidate for the Maine Legislature.

She’s known for her belief that Maine needs to provide a well-rounded education for jobs which will bring young families to Windham and says an excellent education is needed for good paying jobs which include skilled trades and for jobs that don’t exist yet.    

Small was appointed to the school board in early 2020 and is a stay-at-home mom who has lived in Windham for eight years.

Small says she believes public education is an investment and was proud to work with the board to create a responsible budget that voters approved even amid the economic uncertainty brought on by the pandemic.  Her priorities include helping to align RSU 14’s procedures with ever-changing regulatory guidelines, and continuation of the district’s Social Emotional Learning work.  

Also vying for seats on the board are Barbara Bagshaw; Jessica M.H. Bridges; Carrie S. Grant; and Michael Pasquini.

Speed reductions ahead for Windham motorists

Maine’s Department of Transportation has authorized a request by Windham officials and local residents to lower the speed limit on three heavily traveled roads in the town.

In October 2019, Windham Police Chief Kevin Schofield requested that the Windham Town Council ask the MDOT to reduce the current speed limits for Gambo Road, a portion of Nash Road, and for William Knight Road on those thoroughfares and to conduct speed studies to reduce the potential for accidents there. Now with Windham’s request approved by the MDOT, reposting of new signs indicating the lower speed limits on those roads will begin by the town’s Public Works Department.       

In his original memo to the Windham Town Council, Schofield said that as Windham has grown and traffic has increased, the need to consider reduced speed limits for those roads has risen.

“Many of these areas have changed over the years to include, walking trails, youth soccer fields, discontinued bridges and increased development and traffic Schofield said. “So lower speeds, and hopefully slower traffic should help increase safety and quality of life in these areas.”

The current speed limit for William Knight Road, which runs between Varney Mill Road and Route 302, is 45 mph. At 1.17 miles in length, it has a rural appearance to it, but with development over the years, Schofield said that there are now 22 residential dwellings on William Knight Road and five intersecting roads off it with 24 residences abutting the roadway.

He said topography plays an important road in the potential for accidents on William Knight Road.

“Approximately in the midpoint of this section of road there is a steep dip into a ravine. This causes a blind spot for a residential dwelling in this area,” Schofield said. “As prior residents would give instruction when leaving the property to look left, right then left again and count to five to make sure a car did not appear out of the dip at a high rate of speed, they reported many near misses over the years.”

In his memo in 2019, Schofield cited that since 2015, there were four crashes on William Knight Road in 2015, one in 2016 because of icy roads conditions, one in 2017 involving a deer and two in 2019 caused by a line-of-sight issues and driving too fast.

The MDOT has authorized dropping the speed on William Knight Road to 40 mph, according to Cathy DeSouza, MDOT’s Southern Region Assistant Traffic Engineer.

For Nash Road between Windham Center Road and Route 302, Schofield said that the current speed limit there is 35 mph and runs about three-tenths of a mile long.

He said the topography of Nash Road, lack of sidewalks and its short length frequently leads to speeding there.

“I receive complaints about speeding on this section of road, in particular about the rate of speed vehicle crests the steep hill on the west end or the road near Windham Center Road,” Schofield said. “When traveling this section of road at 35 mph it feels too fast for the conditions.”

The speed on Nash Road will dropped to 30 mph, Schofield said.

On Gambo Road, starting at the intersection of River Road and running southwesterly for four-tenths of a mile, the current speed limit is 35 mph, but it does pose a safety issue because of its location.

“Formerly the bridge over the Presumpscot River accommodated vehicular traffic into the town of Gorham, this is no longer the case creating a dead-end road,” Schofield said. “The mountain division recreation trail also crosses the lower end of Gambo road.  Probably most significant is the location of the recreation fields at located near the end of the road that accommodate various recreation programs.  This situation creates more traffic than one would expect on dead end road with few dwellings.”

He said every year the Windham Police Department receives speed complaints on the road and efforts officers to slow traffic down on Gambo Road haven’t worked.

In a letter from the MDOT to the town of Windham, DeSouza said the agency has authorized a speed reduction for Gambo Road to 30 mph. 

“Within the past several months three roads were reviewed for speed limits as requested by residents,” said Windham Town Manager Barry A. Tibbetts. “Chief Schofield has been in contact with the State MDOT, which is the only agency to modify a speed on public road. The process can take up to nine months or more.  The agency looks at a number of factors, ranging from safety conditions, site distances, number of curb openings (driveways), vertical inclines, road widths, traffic volumes crash data points, engineering judgements, etc.  The agency has recommended lowering the speed limits on two different road sections, Gambo and Nash Roads, by 5 mph per hour and establishing a new speed limit of 40 mph on another, William Knight Road. These reviews provide excellent guidance in maintaining safety and traffic flow within Windham.”

According to Schofield, once all of the new signs have been put in place by Windham DPW crews, Windham police will begin enforcing the new speed limits for these roads and also alerting drivers of their speed on others through the use of the police department’s electronic road sign. <

Windham budget proposal works toward council vote

Town could create new ballfields at Manchester School location

Windham has moved a step closer to formulating a town budget for the next fiscal year following a review of proposed expenditures and funding during a town finance committee meeting on Tuesday evening.

On Zoom, Windham Finance Committee members reviewed and discussed the proposed 2021-2022 budget with the town manager and department heads prior to presenting the proposal to the town council at an upcoming meeting.

Windham Town Councilors are expected to take up the proposed budget in April and make whatever adjustments are required before residents vote on the budget at the annual town meeting on June 12.

During this review, Windham Town Manager Barry Tibbetts told finance committee members that the budget contains funding to create two new ballfields, one for softball, one for baseball and another separate recreational field on unused property behind Manchester School.

Tibbetts said that he’s held discussions with RSU 14 Schools Superintendent Christopher Howell about developing the site, which is adjacent to several existing baseball fields there used by the Windham Softball Association and Windham Little League. Clearing and developing the wooded area would take more than a year and would also lead to the creation of a road that would connect Route 302 and Route 115.

“These new fields would be funded by town impact fees and debt retirement,” Tibbetts said. “There will be no changes to the mil rate in doing this.”

In addition to that project, Tibbetts said the budget proposal also includes funding to expand the Lowell Preserve parking lot.

“We can absorb both of these projects with debt retirement and some impact fees,” he said.

Windham Parks and Recreation Director Linda Brooks said because of COVID, the past year has been a significant challenge as more area residents discovered town parks and trails as a great way to get outdoors and have fun during the pandemic.

“We really brought forward new and unique ways for recreation,” Brooks told the committee members. “More people are using the trails and parks for outdoor activities than ever before. As we move forward in the next fiscal year, we’ve had to decide what new programs to offer and what programs can be sustained.”

Brooks said that because more people are now familiar with Windham’s trails system, she expects trail usage to be even busier in the year ahead.

Brooks was one of several Windham department leaders to present ideas and discuss funding requests and proposals during the Finance Committee meeting. Departments presenting budget proposals at this meeting included Fire and Rescue, Police, Communications, and Public Works.

At a previous Finance Committee meeting on March 10, departments presenting budget requests and proposals included the Town Clerk’s Office, Assessing, Code Enforcement, Planning, Windham Public Library and the Windham Economic Development Corporation.

During Tuesday’s presentations, Tibbetts revealed his list of budget proposal adjustments.

Some of that proposed funding includes $242,673 for Parks and Recreation; $86,729 for Parks and Trails; $12,250 for SummerFest; $2,426,818 for Fire/Rescue, water hydrants and fire/rescue vehicle maintenance; $2,730,346 for Police with $43,104 for Animal Control, and $100,660 for police vehicle maintenance.

Other proposed 2021-2022 funding discussed at Tuesday’s Finance Committee meeting includes $445,153 for Communications; $842,760 for highway maintenance; $48,000 for traffic safety devices and equipment; $209,000 for traffic lights and signals; $45,000 for winter highway sand; $129,986 for snow removal; $598,771 for building maintenance and $98,581 for grounds maintenance. The proposed budget also includes $540,399 for vehicle maintenance and fuel costs and $277,250 for waste disposal.

Tibbetts said this budget’s goal is to maintain the services and programs of the town while implementing capital improvements to improve the community.

“In the proposed budget 2021-2022, we are looking to accomplish several objectives; hold the budget increase due to the COVID impacts on residents and businesses, continue with the paving and equipment replacement programs, develop recreational playing fields and playground while expanding parking at Lowell,” Tibbetts said. “The first item is to hold or limit any increases in the budget to the minimum based on the COVID impact to residents and businesses. The municipal budget increase is at 0.33 percent, or flat or no increase to the mil rate.” 

According to Tibbetts, Windham does have some retiring debt from leases and bonds and needs to use that borrowing capacity to address a number of paving projects around the town which were delayed last year.  He said this will also result in no impact to the mil rate.

“We need to address a few personnel positions which will provide better service and position the town for the future,” he said. “Those positions include Fire/Rescue, Assistant Town Manger and additional code enforcement staff. We have several parks projects which will address parking at Lowell field, provide three new fields at Manchester School and we are working with the RSU on this plan, continued improvements at the Community Park and a playground at Lowell.”

Without significant changes made before being discussed and voted on by the Windham Town Council, Tibbetts will propose a budget of $35,115,270 to councilors on April 6. That amount is up marginally from 2020-2021’s budget of $35,048,303 with the mil rate of 4.4 that is  unchanged from last year’s budget.

The RSU 14 school budget has yet to be determined. <

Windham establishes new TIF districts, amends another one

If Windham is to sustain orderly growth and development now and into the future, the importance of continuous investment and infrastructure improvements remains at the forefront for those leading the town.

With that in mind, the Windham Town Council approved two new Tax Increment Financing Districts and amended an existing TIF at its Jan. 26 meeting. Councilors conducted public hearings about the issue and agreed to establish new 30-year TIF districts for North Windham and South Windham and voted to amend the current NW Roosevelt Trail TIF.

“With the public hearings the town has approved these TIFs and have now sent the materials to be approved by the Department of Economic and Community Development at the state level,” said Windham Town Manager Barry Tibbetts. “These TIFs are for infrastructure improvements, roads, sidewalks, lights, sewer, transportation needs, and traffic improvements.

Tibbetts said that these TIFs do not allow for any credit enhancements to be paid out or shared with any businesses or developers.

According to Tibbetts, Tax Increment Financing Districts are great tools for the community and allow for very effective use of those incremental valuation tax funds.

“The TIF in the simplest definition is they support businesses, provide for essential improvements for the community through strategic planning,” Tibbetts said.

Here in Maine, Tax Increment Financing is a flexible finance tool used by towns and municipalities to leverage new property taxes generated by a specific project or projects within a defined geographic district. Any portion of the new taxes generated may be used to finance public or private projects for up to a defined time period of 30 years.

The town gets to outline the TIF district size and boundaries, determines the amount of new taxes to be captured, identifies allowable public and private projects and exercises oversight for the TIF district.

TIFs may provide funding for a business seeking an investment or it could reserve a portion of newly generated revenue for specific public use that benefit as community ranging from upgrading a road or adding on to an existing structure or facility without affecting a decrease in state revenue as a community prospers.

As the tax foundation of a community expands as the town develops, conversely it eases the tax burden on residents and businesses. TIFS foster and encourage new development by allowing a community to retain new tax money without losing state revenue.

Tibbetts said by state law, Windham is limited to the total area allowed within TIF districts but is only using 1.5 percent of an allotted 5 percent overall.

“The TIF allows the community to capture 100 percent of the dollars to be used for improvements such as sidewalks, roads, lighting, traffic improvements, etc.,” he said. “This occurs since the identified valuation is separated from our total town valuation. The result allows certain funds from the state to increase and other responsibilities to decrease since these are based on the total town valuation.”

He said that because of the TIF approval, the town will pay less county tax creating savings for the town budget, RSU 14 will receive a greater share of the State Aid to Education funding lessening the burden to the local property taxpayers, and it increases the revenue sharing dollars Windham now receives from the state.

“Since TIFs allow the incremental taxes to be dedicated to specific projects, we are able to apply long term funding to specifically address anticipated issues in the future,” Tibbetts said. “For example, we know traffic through the northwest area of Windham in the summer is a problem, we know heading south on Route 302 and taking a left at Route 115 is challenging, and we know having a sewer system within certain areas preserves water quality and allows for business growth and jobs, there are many needs to address. These items and many others will need funding to correct.”

Using TIFs allows the town to plan for these changes, use the funds set aside to match Federal and State Grant programs and pay for improvements, and lowers the burden for taxpayers in the municipal budget, Tibbetts said.

“Short term we are able to use funds to bring in the necessary consultants to assist in solving and identifying items,” he said. “These TIFs put in place the ‘vehicle’ for the town to get to an end solution.” <

Windham Town Council elects new chairperson, makes committee appointments

In the aftermath of this month’s election with two members sworn in and taking seats on the Windham Town Council, councilors elected a new chairperson and sorted out committee appointments in a meeting via Zoom on Nov. 10.

Councilor David Nadeau was elected as the new council chair, succeeding Jarrod Maxfield, who was voted as the new council vice-chairperson. Councilor David Douglass was chosen as the council parliamentarian.

Nadeau is a retired electronics engineer who has served on the Windham Town Council for eight years and was a member of the town Planning Board for 10 years. In September he was presented with the 2020 Planner of the Year Award by the Maine Association of Planners.

The council also chose Nadeau to serve on the Finance Committee along with Councilors Mark Morrison and Nicholas Kalogerakis. Elected to serve on the Appointments Committee are Councilors Douglass, Kalogerakis and Maxfield.

Morrison, who was elected Nov. 3 as an at-large representative, will join Maxfield in serving as the council’s representatives to the Windham Economic Development Board.

Douglass and Kalogerakis will represent the council on the Marijuana License Fee Committee, while Maxfield and Nadeau will serve on the Public Dire Road Sub-Committee.

The council elected Maxfield to serve as a member of the Highland Lake Leadership Team and Nadeau to serve on the Long-Range Planning Committee.

Councilor Tim Nangle was elected to serve on the Parks & Recreation Advisory Committee, while
Douglass was chosen to serve on the Natural Resources Advisory Committee.

Councilor Brett Jones, who was elected to represent the East District on Nov. 3 will serve on the Public Easement Advisory Committee. Maxfield and Nadeau will serve on the Smith Cemetery Committee.

Councilors also appointed Elizabeth Hall, James Ross and Ken Dolby to serve on the Smith Cemetery Board.

Jacqueline Roux was appointed by the council to serve a three-year term on the town’s Board of Assessment Review. <

Windham’s famed ‘Tuskegee Airman’ a genuine champion for equality

Fred Williams dies at 98, was Maine’s first black attorney

As a trailblazing member of the Tuskegee Airmen in World War II, Fred Williams of Windham wasn’t content to let racism stop him from achieving his dreams. As the first black attorney to ever practice law in Maine, a former Windham Town Council member, a Baptist minister and a law professor at Saint Joseph’s College, Williams continued to shatter stereotypes right up until his death last weekend at the age of 98.

Born in 1922, Williams dreamed of someday attending flight school and was the first member of his family to ever be issued a birth certificate. He joined the U.S. Army Air Corps upon graduation from high school in New York City, but because of the enforced segregation in the U.S. Armed Forces at that time, Williams was assigned as a cadet in a new pilot training program for African Americans at Tuskegee Institute in Alabama.

Nearly 1,000 black pilots and about 15,000 black air support personnel trained in the program and became known as the Tuskegee Airmen, the only black pilots to fly combat missions during World War II. They flew more than 15,000 individual missions in North Africa and Europe during the war, earning more than 150 Distinguished Flying Crosses for valor and paving the way for the eventual integration of the U.S military. 

"I wanted to be in a bomber, especially a B-17,” Williams told members of Windham’s American Legion Field-Allen Post and VFW Post 10643 during a memorable visit with local veterans at the Windham Veterans Center in 2017. “It was hell getting in, but we were proud.”

Williams told the audience how the Tuskegee Airmen never saw their race as an impediment or barrier to defending their nation in wartime.

He hailed the decision by President Harry Truman to desegregate the U.S. military in 1947 as monumental to achieving equality in the American’s armed forces.

“It’s one Army, one Navy,” Williams said. “It all shows we are one nation. Greek American, Japanese Americans, that’s race, not Americans. Color is not a race. White is not a race. Black is not a race, it’s a beautiful color.”

Williams was recalled to military service for the Korean War and then returned to New York City once he was discharged, where he studied and earned degrees from the City College of New York and the New York Law School. He also worked as a U.S. Federal Treasury Department agent.

Moving to Maine, he passed the bar exam and in doing so, Williams became the first black lawyer ever in the state in 1969, beginning first as an attorney for Casco Bank and then going on to launch his own private practice. Later he served as the president of the Bar Association for the State of Maine.

Making his home for decades in Windham with his wife, Laura, and their four sons, he was elected to serve on the Windham Town Council in 1971 and also was a proud member of the Windham Lions Club, where he eventually served as a district governor for the Lions International organization.

Fred was one of only two Tuskegee Airmen I have ever met and that, in itself, was certainly an honor,” said Willie Goodman, VFW Post 10643 commander. “Fred was an engaging man with a twinkle in his eye and was very passionate about what he believed in.  Fred was proud of what he accomplished in the military and as a lawyer in Maine.  I feel honored to have had a special friendship with Fred and I am thankful and happy for the visits my wife and I had with him that we'll always remember.”

David Tanguay, adjutant of the American Legion Field-Allen Post 148, said Williams was a charismatic life figure who was honored to become an honorary member of the American Legion post in Windham.

“I recall a veterans coffee meeting one Wednesday when Fred dropped in.  He captivated the veterans with his stories of the Tuskegee Airman during World War II and Korea and made a larger-than-life impression on all,” Tanguay said. “I was impressed with his varied care path from military pilot to lawyer to Town Council member to advocate in the community. He will be missed." 

Never wavering on his commitment to civil rights or forgetting his family’s social justice struggles when he was young, Williams marched in Selma, Alabama in the1960s with Dr. Martin Luther King, Jr. and championed equality, justice and liberty for everyone, regardless of race or ethnicity.

He taught Business Law at Saint Joseph’s College in Standish for many years and spent his final days at the Maine Veterans Home in Scarborough.

Williams is survived by his four sons and their wives including Manuel (Jill), Fredrick, II (Roxanne), Keith (Arlene), and Kenneth Williams; five grandchildren; and six great-grandchildren. His wife Laura passed away in 1988.

Funeral services for Williams will be private. <

For those eagerly awaiting the first day in Maine that adult use retail marijuana can legally be sold on Friday, Oct. 9, expectations will need to be tempered. And right here in Windham, it may be months or up to a year before retail adult-use marijuana shops are open and operating.

On Tuesday evening the Windham Town Council gave its final approval for the award of two adult-use retail marijuana licenses, voting to rescind the license of a business that had been awarded a conditional license on Sept. 15, replacing it with another candidate and finalizing the other retail license awarded to Paul’s Boutique.

Windham RSL had been awarded a conditional adult-use marijuana license previously by the council, but information received by the town manager concerning the lease contained in its license application was called into question. During a public hearing Tuesday, Councilors Jarrod Maxfield, David Nadeau, Nicholas Kalogerakis and David Douglass voted 4-0 for a finding of fact that without the submission of a master lease or sublease in the application of Windham RSL, the original vote on Sept. 15 was rescinded and the next highest finisher in their adult-use marijuana retail license scoring system, JAR Cannabis Co., should be awarded the license instead.

The lengthy town and state application hurdles for adult-use retail marijuana and uncertainty about the
licenses though, has led to a significant delay in Windham for adult-use retail marijuana shops being ready to open for business right away.

“We will definitely not be ready by Oct. 9,” said Shaw Dwight, the owner of Paul’s Boutique. “We’ve been positioning to hope to be awarded a license for over a year and discussing this with the town for over a year. Our company has done its due diligence to be professional with the store. It’s now time for my company to start preparing to enter the adult-use market to be successful.”

Dwight said rampant uncertainty about state and municipal regulations, ordinances, applications, and licensing has led to a bottleneck in the wholesale marijuana market right now, resulting in exorbitant prices for a limited number of products available and a poor supply to meet the market demand right now.

According to Dwight, the entire process of growing, drying and trimming marijuana for retail sales also takes time.

He said his company wasn’t ready to invest in a retail cultivation facility to deal with logistical issues and finalize other plans until it knew it was going to have a license and now that it does, the business can move forward. 

“We need to prepare this company for the future, but it will take some time, at least a year,” he said. “We have a conditional license from the state, but now we can go back and get a true license from the state. You can’t put the horse before the cart. We’re just trying to set up a plan that will ensure success.”

Dwight said he feels that not being totally prepared for what lies ahead for the adult-use retail marijuana business in Maine is naïve.

“Being prepared means being able to control reasonable price points, the availability of extracts and
edibles and the consistency to offer a diversity of products,” he said. “We’re not there just yet, but within six months to a year we will be. Now our work truly begins.”

Joel Pepin, who owns JAR Cannabis Company, said he was grateful to have been awarded an adult-use retail license by the council, but like Paul’s Boutique, find themselves in a similar place.

“Now that we’ve gotten local authorization from the town, I think it will take about a month to obtain a license, the state office seems to be moving quickly.”

Pepin said this year many medical marijuana providers have struggled to keep their supplies up for the demand and he expects that to be the case with adult-use as well.

“I don’t know exactly when we will make the transition from medical marijuana to adult-use, but we have two facilities and that could only be a couple of weeks,” he said. “We’ve got a lot of patients who are visiting our existing storefront and we want to make it a smooth transition for them and not alienate our existing patient base.”

According to Pepin, his biggest challenge going forward will be the keep costs low enough for his existing patients.

“We want those patients to be able to shop with us, but they may find that the excise tax and sales tax costs could go up,” he said. “We want our patients to go out the door with products at similar prices.”

Because they are vertically integrated where the products they sell come from their own garden and extraction lab, Pepin said that Jar Cannabis Company may initially be behind a bit in selling edible products, but he expects that to all work out over time.

“We’re aiming to be up and make the transition to adult-use by the end of the year or within the first few months of the new year,” he said. <

Windham to issue two adult-use marijuana retail licenses next week

A long and complicated road for the Windham Town Council could be in the rear-view mirror next week as decisions about applicants for two adult-use marijuana licenses will finally be determined.
Windham Town Manager Barry A. Tibbetts said that a special meeting of the Windham Town Council will be conducted at 6:30 p.m. Tuesday, Sept. 15 at the Windham Town Hall to review applicants for several marijuana business licenses in the town. All other marijuana license applications will be discussed or approved by councilors on Sept. 22.
“These are the two adult use licenses,” Tibbetts said. “By our ordinance we will only award two and those applications per the ordinance were due at the end of July.”

The new ordinance officially took effect on June 26.
Tuesday’s license review caps a four-year process for the town after voters in Maine approved a statewide referendum in 2016 to legalize marijuana for recreational use for adults over the age of 21. A string of lawsuits and time-consuming legislative reviews further delayed the process to this point, although the state already had an existing medical marijuana program.
There are currently nine marijuana businesses in Windham which will be grandfathered into the town’s existing land use ordinance. The land use ordinance also was approved in May and requires that licensed marijuana facilities have a minimum of 1,000-foot setbacks from schools and a minimum of 250-feet setbacks door to door from day care facilities.
Under the provisions of the new marijuana ordinance, Windham will license seven different kinds of marijuana establishments including two adult use retail stores, a cultivation location, a manufacturing location, a registered medical caregiver cultivation location, home medical caregiver cultivation, a testing facility and a medical marijuana caregiver shop.
The new ordinance prohibits growing plants outdoors and mandates that vendor and personal licenses must be obtained before marijuana can be grown.

** Adult-Use Marijuana Store - $2,500
** Marijuana Cultivation Facility - $1,000
** Marijuana Manufacturing Facility - $1,000

Tibbetts said that the license fees will be directed at substance use education and prevention, but specifics on that have yet to be determined by the council.

When Windham’s town manager reviews what has been accomplished by the town council in the past year, he sees a lot for residents to be proud of.
Barry Tibbetts assumed duties as Windham Town manager last fall and says he’s been amazed at how prioritized the council has been in getting things done.
“A lot of things have been looked at and worked on,” Tibbetts said. “We’re at a point to make changes for the betterment of the community.”
Led by council chair Jarrod Maxwell, Windham town councilors are focused on resolving longstanding issues despite varying viewpoints and differences, Tibbetts said.
Some of what has been achieved in the past year includes establishing and clarifying town policies dealing with growth, marijuana and the use of town facilities.

“Growth affects everything we do in our community,” Tibbetts said. “It affects everything from traffic and water quality to the size of our schools and the council wants to ensure we grow in the right way. We can now do that with these new policies and ordinance in place.”
He also said councilors resolved questions about the town’s marijuana ordinance by examining revisions to existing state law, comparing Windham’s rules with other Maine municipalities and then revising its ordinance accordingly. As such, the town is now entering the application phase for adult-use marijuana businesses and that process will be completed by early fall.
https://www.portresources.org/“This is a huge accomplishment for the council,” Tibbetts said. “This has been a point of contention for some time and it’s great to see the council reach a consensus regarding this ordinance.”
The other major policy issued that councilors have addressed is about the utilization of operational space by the town following studies conducted in 2013, 2014 and 2019 for several buildings. It resulted in space better used by Windham Police and Fire Departments, Tibbetts said, and a recommended expansion of operational space for the town hall.
“As far as the police station goes, previous engineering studies showed a building built for 22 in 1989 now houses more than 45 people,” he said. “Through efforts of the council, bonding for renovation of the police facility was approved by voters at the annual town meeting. The design and construction phase for that work is now starting. The same approach took place for the Fire Central Station with the renovation for that facility built to the latest standards and providing growth space for the department in the future.”  
Tibbetts said that councilors also are examining how to resolve traffic issues through the town, including North Windham.
According to Tibbetts, funding has been obtained for smart traffic lights to interconnect on Route 302 to assist traffic in flowing better in Windham and the town has also entered into a study with the Maine Department of Transportation regarding access roads to keep traffic moving smoothly on Route 302.

This project has been stalled for many years,” Tibbetts said. “We now have an agreement with the Portland Water District to determine the feasibility of using new sewer technology and determining, as cost will allow us to make a better-informed decision. Prior to this approach we were held captive to a $55 million expense to Westbrook now due to inflation closer to $75 million, but this new approach with advanced technology will yield a much lower long-term cost. No waste will be pumped to Westbrook.”
Other projects that have been accomplished over the past year in Windham include funding of sidewalks on Route 35 at Route 302; the installation of LED streetlights that will save Windham roughly $65,000 a year in operational costs; creating a new turn lane from Route 302 and paving of Brand Road; creating additional parking and improvements at Lippman Park; separating the TIF budget from the municipal budget; a thorough review of all town fees to reflect a more accurate reflection of service costs; moving Public Works into its new facility; implementing a Code of Ethics for town councilors and adopting a town social media policy.
Ongoing projects that should be completed soon include reworking the drainage system along the east side of Highland Lake to adhere to storm water compliance; entering Phase 2 of improvements to the Windham Skate Park; and issuing a Request for Proposals to developers for their best approach to creatively reusing the Southwest Fire Station.
“Windham has been looking at all of these issues for some time but hasn’t been able to get them over the finish line,” Tibbetts said. “This council has done a commendable job in working together to get these completed for the town and we all can take great pride in what has been accomplished this past year.” <

New town marijuana ordinance is in full swing as deadline for business applications has closed

The approved town ordinance on the sale of Recreational Adult-Use and Medical Marijuana Storefront facilities as well as business and personal marijuana outdoor cultivation that was voted on, approved, and adopted by the Windham Town Council on May 26 officially took effect on Friday, June 26.
The deadline, however, for business applications occurred July 27 and will be forwarded in a month to the Windham Town Council for consideration. A special Windham Town Council meeting will be called on the first or second week of September to review and address the applications.
A four- to five-year process in the making, the Town of Windham has considered this new business and perhaps controversial model for a while. All the while, the town itself has seen retail marijuana storefronts increase to the present number of nine businesses. Some see this as economic development while others view this as a moral or youth-based use issue. Whatever the case may be, the Windham Town Council has diligently considered both perspectives in the past four years.
“Marijuana vendors began to build their businesses in 2016-2017,” said current Town Council Chair, Jarrod Maxfield. “Council members at that time – along with the Windham delegation, toured the facilities that were established. The vendors built their businesses immediately following the vote to approve medical marijuana at a time when there were no state regulations. The 2016-2017 Council chose not to ‘opt out’ of having marijuana business in Windham. As a result, it fell to the current 2020 Council to take a highly unregulated industry and put regulations on it.”
https://jobs.spectrum.com/In the past couple of years, former and current Town Council meetings have had the sell of medical marijuana as a business on their agenda with public comment on both sides of the perspective.
After much consideration and public comment, the current Council considered as many angles on this issue as possible and finally reached the current ordinance which includes the following:
1)      One must be licensed to own a business.
2)      Two recreational, adult-use storefronts are allowed in the town.
3)      Four medical marijuana storefronts are allowed in the town.
4)      No marijuana plant can be grown outdoors. This includes both vendor and personal plant growth.
5)      For businesses, fees to apply for vendor license will be required. The fees are as follows:
Adult Use Marijuana Store - $2,500
Marijuana Cultivation Facility - $1,000
Marijuana Manufacturing Facility - $1,000
Medical Marijuana Registered Caregiver - Cultivation conducted on site - $300 Medical Marijuana Registered Caregiver (Home Occupation) - Cultivation not conducted on site - $150
Medical Marijuana Caregiver Retail Store - $2,500
Marijuana Testing Facility - $1,000
“The fees will go toward substance use education and prevention, but the parameters and specifics have yet to be determined,” said Windham Town Manager Barry Tibbetts. “The town council will discuss and consider these factors in the near future.”
Town Council Chair Maxfield said that the intention of the ordinance is to limit storefronts to a total of two adult-use and four medical storefronts.
“Currently, there are nine storefronts,” said Maxfield. “These storefronts are grandfathered in.  When a marijuana business decides to close, it will not be replaced. At this point – there will only be a total of six marijuana businesses in Windham – limited to two recreational adult use and four medical marijuana storefronts.”
Two business owners offered their thoughts on the new ordinance put in place.
“As a member of the appointment committee, I helped draft the Town of Windham Marijuana Business Licensing Ordinance,” said Shaw Dwight, the owner of Paul’s Boutique. “I recognize and am grateful for the time and commitment put forth by council members on this subject. Paul's Boutique has been doing business in Windham since 2016, and this ordinance could allow us to expand our offerings at our store on Route 302 into the adult use market. The Town's cap on adult use marijuana stores, however, will make this an extremely competitive licensing process. I agree that the Town should be able to know and control who operates in the Town but do feel there may be a tendency for municipalities to over-regulate cannabis.”
Charles Hawkins, owner of Maine Alternative Caring, shared his thoughts in terms of a Windham resident rather than a property owner.
“I have two major concerns as property owning resident of the town,” Hawkins said. “The impact of this ordinance on Windham residents in terms of personal outdoor marijuana growth is a huge injustice. Whether one is growing for recreational or medical use, an individual is halfway through this season’s harvest as this ordinance is implemented. That is a lot of money invested in plant growth. Not only that, the implementation of this ordinance is a burden on the taxpayer in terms of police and code enforcement. My second major concern is the limitation of marijuana business growth to Enterprise Drive in North Windham. I find that this may be a violation on property owners’ rights as well as possible income for vacant farmland owners. What about other property owners who have the land to offer cultivation, providing a rental income on their property? Why should this be limited to Enterprise Drive?”
Although it is true that both sides of the perspective may not be happy, Maxfield believes the Town Council did their best trying to meet all sides.
“Neither side, for or against, is happy with the ordinance outcome,” Maxfield said. “But for me, this is a positive thing. That indicates to me the Council found a middle of the road answer while regulating and putting some control on the expansion of the marijuana industry in our town while at the same time addressing the concerns of Windham residents who believe we have too many marijuana businesses in a such a small town.”

Windham residents approve town budget during annual meeting

A total of 49 residents were in attendance and sat in designated seating to adhere to the social distancing regulations determined by the State Center for Disease Control. Everyone was asked to wear masks.

All articles previously approved by the Windham Town Council were voted on and passed by the Windham residents in attendance.
